Forensic Accounting
Forensic accounting involves the application of accounting, financial analysis, and investigative skills to matters that may be subject to litigation. Engagements may include the analysis of financial issues related to estate matters, partnership or shareholder disputes, matrimonial proceedings, fraud investigations, or cases involving financial exploitation of vulnerable individuals. Because these matters may ultimately be presented in court, the work performed must be thorough, well-documented, and capable of withstanding legal scrutiny.
A forensic accountant may be retained as either a consulting expert or a testifying expert. When serving as a consulting expert, the forensic accountant works closely with legal counsel to analyze financial issues, assist with case strategy, and evaluate potential damages. In many circumstances, the consultant’s work may be protected under the attorney work-product doctrine and is generally not subject to discovery.
When engaged as a testifying expert, the forensic accountant provides an independent and objective opinion regarding financial issues or economic damages. This work may include the preparation of expert reports, analysis of financial records, and testimony in deposition or at trial.
